Who controlled the playing area?
If a business invites you onto its property for a business purpose, Delaware law generally treats you as a business invitee. A person or business that possesses and controls the playing area has to use reasonable care to keep it safe, even if another party shares control. That duty includes taking reasonable care to discover hazards that pose an unreasonable risk.
Once staff find a dangerous condition, the facility generally has to make the area reasonably safe or warn you about the risk. An obvious danger can affect the duty to warn, but it does not always end the duty to keep the property safe. Delaware also limits liability for some people and groups that own or control land when they allow free recreational use.
How can you prove the hazard existed?
You still have to link the unsafe condition to your injury. Photos you take soon after the incident preserve the surface before staff make repairs. They also document the defect’s location and apparent size.
Records can help show what the facility knew and when. Maintenance logs often show when staff last inspected or repaired the area. Earlier complaints can show that someone had already reported the problem. Even without a complaint, the time the hazard remained may matter if staff would have found it through reasonable care.
